Shri Krishna Janmabhumi case: Supreme Court refuses to stay Allahabad HC order allowing plea to appoint advocate commissioner to inspect disputed structure

The Supreme Court on Friday refused to stay Allahabad High Court order allowing a plea to appoint advocate commissioner to inspect the disputed structure.

The apex court directed the concerned parties to approach it only in the event of an adverse order. Emphasising that the Allahabad High Court should address the survey’s modalities on 18 December, the Supreme Court asserted that parties could approach it if an unfavorable order is issued.

“Shahi Idgah Masjid and Sunni Central Waqf Board had challenged the Allahabad High Court order and sought stay on proceedings. The Supreme Court has refused to stay the proceedings and scheduled the challenge to the transfer order for 9 January,” Vishnu Shankar Jain, the lawyer representing the Hindu side, said.

“The High Court order will persist, and the matter will proceed without a stay from the Supreme Court,” he added.
